A Nairobi court has dismissed charges that were levelled by the state against web developer and activist Rose Njeri, with the magistrate saying they not disclose any offence in law.
Principal magistrate Geoffrey Onsarigo ruled on Friday June 20 that the two counts levelled against her were ambiguous and could not stand.
“The two counts as presently presented do not disclose an offence as they are ambiguous,” Onsarigo said in his ruling.
The ruling followed a spirited fight by lawyers representing Njeri who had challenged the charge sheet, arguing it was defective.
Njeri had been arrested and rraigned to face charges of cybercrime and misuse of computer.
Onsarigo had earlier this month released Njeri on a personal bond pending Friday’s ruling in which she ordered that she be freed.
Her lawyers also asked the court to order that electronic devices confiscated during her arrest be returned.
They included a hard drive, mobile phone, flash disks, and a CPU.
The prosecution told the court that the devices were still being processed by the cybercrime unit and would be returned once the review is complete.
However, the court ordered that all items confiscated from Njeri be released to her immediately.
